2025 PRIMARY KIDS GRAPHIC TEE CONTEST OFFICIAL RULES
Sponsored by Primary Kids, Inc. (“Primary Kids”).
THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK OR INSTAGRAM.
NO PURCHASE OR OBLIGATION NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR WHERE RESTRICTED BY LAW.
The 2025 Primary Kids Graphic Tee Contest (the “Contest”) begins on May 19, 2025 at 12:00 AM ET and ends on June 30, 2025 at 4:00 PM ET (the “Entry Period”). Primary Kids’ computer is the official clock for all matters related to this Contest.

Agreement to Official Rules. By entering or participating in the Contest, Entrants (as defined below) accept and agree to be bound by these “Official Rules.”

Eligibility. The Contest is open to legal residents of the fifty (50) United States and the District of Columbia who are between five (5) and twelve (12) years of age at the time of entry. Those creating artwork, or “Artists”, must have permission from a parent or legal guardian to participate, and parents or legal guardians of such Artists are required to review and accept these terms and submit entries on Artist’s behalf (“Entrants”). Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within the past six (6) months, performed services for Primary Kids, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest and/or their respective parent, subsidiary, affiliated and successor companies (collectively, the “Contest Entities”), and immediate family and household members of such individuals, are not eligible to enter the Contest. For the purposes of these Official Rules “Immediate family members” mean parents, step-parents, children, step-children, siblings, step-siblings or spouses, regardless of where they live; and “Household members” mean people who share the same residence at least three (3) months a year, whether related or not.

How to Enter. Entrants may enter the Contest during the Entry Period as follows:

Artist must create an original piece of two-dimensional artwork (by drawing, painting, coloring or collage) on a single, blank 8.5” × 11” sheet of paper that showcases Artist’s favorite thing in Artist’s favorite color(s) (“Original Artwork”).

Visit http://primary.com/artcontest and fully complete the online submission form (“Submission Form”), including:

Artist’s first and last name and age;

Email address for Entrant;

A title and a short description of the Original Artwork and why Artist chose the subject matter;

Upload a clear scan or photograph (PDF preferred) of the Original Artwork through the Submission Form (note that if selected, winning Entrants will be required to mail a hard copy of the Original Artwork to Primary Kids); and
-
Confirm that these Official Rules have been reviewed and affirmatively accepted, along with the relevant Release (as defined below).
LIMIT ONE (1) ENTRY PER ARTIST IS PERMITTED, REGARDLESS OF ENTRY METHOD. If multiple submissions are received from the same Artist, only the first submission will be considered. Subsequent attempts made by the same Artist to submit entries in excess of the above-stated limit by using multiple email addresses or similar means are void. Entries that are fraudulent, forged, altered, incomplete, lost, late, misdirected, mutilated, illegitimate, incomprehensible, garbled or generated by a macro, bot, script or other automated means will not be accepted and will also be void. Entrants violating any of these Official Rules may be disqualified. All entries (except for the rights to use each Artist’s Original Artwork submitted, which are licensed to Primary Kids pursuant to the Release (as defined below), and as otherwise stated herein) become property of Primary Kids, and none will be acknowledged or returned. Proof of submission of entry does not constitute proof of receipt of same. By entering this Contest, Entrants agree the decisions of Primary Kids is binding and final in all matters relating to this Contest.
4. Selection of Winner. The potential winners (“Winners”) will be selected from all eligible entries received meeting the requirements of these Official Rules within three (3) days following the end of the Entry Period judged on the following characteristics and criteria:

Does the Original Artwork display authenticity and enthusiasm for Artist’s favorite thing?

Is Artist’s favorite thing clearly depicted?

Is the use of color in the Original Artwork compelling and emotional?
-
Will the Original Artwork reproduce well on a white t-shirt and in related photography?

The judging will be conducted by Primary Kids from all eligible entries. Submissions will be evaluated separately for Artists: (1) ages 5 to 8 and (2) ages 9 to 12. At least one Winner will be chosen from each age grouping and there will be up to ten (10) Winners in total. The possibility of being selected as a Winner depends on the total number of eligible entries received during the Entry Period.
5. Prizes. The prizes to be awarded from the Contest are as follows:

The opportunity for Winner’s Original Artwork (as may be adapted, enhanced, or modified by Primary Kids in its sole discretion) to be featured on a t-shirt in Primary Kids’ Holiday 2025 collection (starting in October of 2025) and offered for sale on primary.com and through Primary Kids’ distribution partners (including in marketing and promotion related to the foregoing).

One (1) $200 Primary Kids digital gift card.

Total ARV of all prizes to be awarded: Up to $2000 (USD). The ARV for each of the prizes are estimates made before the Contest begins. Any difference between an ARV and the actual cost of a prize will not be awarded.

The prizes are not redeemable for cash or transferable. Except as set forth in these Official Rules and at Primary Kids’ sole discretion, a prize of comparable or equal value may be provided. No further substitutions will be allowed. Prize elements may not be separated and gift cards will not be replaced if lost, mutilated or stolen. Gift cards are subject to terms and conditions thereon. Winners are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to prizes. Entrants agree to provide Primary Kids with any additional information and complete any required tax or other forms relating to receipt of a prize. Prizes will be awarded to Entrants, who must sign the release linked here (“Release”). Allow six (6) to eight (8) weeks for the delivery of gift cards. Without limiting any other terms of these Official Rules, the prizes are provided as-is, without any warranty, representation or guarantee (express or implied, in fact or in law, whether now known or hereinafter enacted) relative to the use or enjoyment of the prizes, including, without limitation, their quality, merchantability or fitness for a particular purpose. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest promotional materials and the terms and conditions of these Official Rules, these Official Rules will prevail and govern.
6. Notification of Winners. Entrants will be notified by email within five (5) business days of Artist being selected as a Winner, and must have affirmatively accepted our Release. If a selected Entrant cannot be contacted, is ineligible, fails to claim a prize and/or Release is incomplete, not accepted, modified or is not received within the number of days specified in the notification or thirty (30) days after such notification, whichever comes first, the prize may be forfeited and an alternate Winner may be selected from remaining valid, eligible entries timely submitted. In the event of a dispute regarding the identity of any Entrant, the entry will be deemed submitted by the natural person who is the Authorized Account Holder of the email address specified in the entry. For the purposes of these Official Rules “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
7. Limitation of Liability.

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW: (I) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED IN PARTICIPATING IN THE SWEEPSTAKES (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (II) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (c) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO ENTRANT.

The Contest Entities are not responsible and/or liable for any of the following, whether caused by a Contest Entity, the Entrant, or by human error: entries that are submitted by illegitimate means (such as, without limitation, by an automated computer program) or entries in excess of any stated limit; any lost, late, incomplete, illegible, unintelligible, garbled, mutilated or misdirected entry, email, mail or Contest-related correspondence or materials or postage-due mail; any error, omission, interruption, defect or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos or misprints in these Official Rules, any Contest-related advertisements or other materials; failures of electronic equipment, computer hardware or software; lost or unavailable network connections or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information; or any human or mechanical interference in the administration of the Contest or the processing of entries. The Contest Entities are also not responsible for electronic communications that are undeliverable or do not reach Entrant as a result of any form of active or passive filtering of any kind or insufficient space in an Entrant’s email or voicemail inbox, or if Entrant’s email address or other contact information does not work or is changed without prior written notice to Primary Kids that is acknowledged by Primary Kids in writing.
8. Release and Indemnity. By entering the Contest, each Entrant agrees to release, indemnify and hold each of the Contest Entities, as well as each of their respective officers, directors, employees, agents and representatives and each of their respective successors, representatives and assigns, as well as Instagram and Facebook, harmless from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest or any Contest-related activity, including any artwork or other material and content submitted by an Entrant in connection with participation in the Contest, or travel, and/or acceptance, receipt, possession or use/misuse of a prize, including without limitation, any injury, damage, death, illness, loss or accident to/of persons or property.
9. Additional Conditions. Primary Kids reserves the right, in its sole discretion, to terminate, modify or suspend the Contest in whole or in part, if in Primary Kids’ opinion: (i) the Contest is not capable of running as planned by reason of the occurrence of any event beyond its control including, but not limited to, fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications, equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Contest by any party, or any federal, state, local or provincial government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Primary Kids’ control; or (ii) any other factors beyond Primary Kids’ reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, in all instances without liability to the Entrants. Primary Kids also reserves the right to disqualify any Entrant or Winner, as determined by Primary Kids, in its sole discretion.
10. Governing Law and Choice of Forum. These Official Rules are governed by the law of the State of New York, without reference to rules governing choice of laws. Any action, suit or case arising out of, or in connection with, this Contest or these Official Rules must be brought in the courts located in the Southern District of New York.
11. Publicity. Except where prohibited, by participating in the Contest, the Entrant’s consent to the use of Winner’s name, ages, photo and/or likeness, entry and statements attributed to Winners (including title and description of the Original Artwork) for advertising and promotional purposes, including without limitation, inclusion in Primary Kids’ marketing emails and newsletters, Primary Kids’ official blog, social media accounts, and in our magazine, the Contest website at http://primary.com/artcontest and Primary Kids’ homepages at http://www.primary.com/, and on third party websites of distributors selling the Primary Kids’ 2025 holiday collection, without additional compensation (including but not limited to any royalty payments).
12. Personal Information. Primary Kids may process personal data about Entrants and Artists in accordance with its Privacy Policy and as may be more specifically set forth in these Official Rules. 13. Winner List. For the names of the prize Winners, once they have become available, send your request and a stamped, self-addressed envelope to 2025 Primary Kids Graphic Tee Contest, Primary Kids, 530 7th Avenue, Suite 1902, New York, NY 10018 or send an email message to help@primary.com with “Winners List” as the email subject and 2025 Primary Kids Graphic Tee Contest specified in the body of the email. Requests must be received within six (6) months of the end of the Entry Period.
